General Terms and Conditions

1. SCOPE OF APPLICATION

These General Terms and Conditions (GTC) apply to all business relationships between MixArt AG, Haldenweg 7, CH-3510 Konolfingen, UID CHE-247.207.443 and its customers. The GTC apply to both private and business customers.

2. CONCLUSION OF CONTRACT

2.1 The presentation of our services and products on our website and other advertising materials does not constitute a legally binding offer, but an invitation to place an order.
2.2 By ordering a service or product, the customer submits a binding offer. The contract is only concluded upon our express acceptance of the offer.
2.3. offers (quotations) from MixArt AG are valid for 30 days from the date of the offer, unless otherwise stated.
2.4 Cost estimates are non-binding. Should deviations from the cost estimate become necessary during the execution of the work, the customer will be informed immediately. Invoicing shall be based on actual expenditure.

3. PERFORMANCE

3.1 Recording studio
Our recording studio services include producing and recording, mixing and mastering as well as film sound and advertising. In addition, we offer artists our label service, which includes support with the publication and release of their works.
3.2. Event technology
In the area of event technology, we offer comprehensive services for concerts and festivals as well as for congresses and conferences. We also specialize in multimedia installations, ranging from consulting, planning and conceptual design to final installation and training. We also hire out personnel and equipment as part of our Freelancer & Rental service.
3.3. Teaching
Our teaching offering includes the Studio Academy, which offers an annual course in recording studio engineering, and the Live Academy, which offers courses in event technology. In addition, we organize workshops on various topics related to audio technology and offer individual lessons on instruments or vocals.

4. PRICES AND TERMS OF PAYMENT

4.1 All prices are quoted in Swiss francs (CHF) including VAT.
4.2 Payment shall be made in accordance with the terms of payment specified in the offer or order confirmation.
4.3 In the event of late payment, we reserve the right to chargereminder fees of CHF 30 and default interest of 5% per annum on the outstanding amount.

5. RIGHT OF WITHDRAWAL FOR PRIVATE CUSTOMERS

5.1 Private customers have the right to withdraw from the contract within 14 days without giving reasons.
5.2 To exercise the right of withdrawal, the customer must send us a clear statement (e.g. a letter or e-mail sent by post) of his decision to withdraw from the contract.

6. LIABILITY AND WARRANTY

6.1 Our liability for contractual breaches of duty and tort is limited to intent and gross negligence.
6.2 We are only liable for damages caused by simple negligence if a material contractual obligation has been breached. In this case, liability is limited to the foreseeable, typically occurring damage.

7. CONFIDENTIALITY AND DATA PROTECTION

7.1 We undertake to treat all information disclosed in the course of the business relationship as confidential.
7.2 The customer agrees to the processing of their personal data in the context of the contractual relationship. Further information on data protection can be found in our privacy policy.

8. FINAL PROVISIONS

8.1 Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
8.2 The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of MixArt AG in Konolfingen.
8.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provisions.

9. Update

These General Terms and Conditions are an integral part of the contract and may be amended by us at any time. The version published here at the time the contract is concluded shall apply.
